Terms and Conditions

The following general terms and conditions (hereinafter referred to as “GTC”) apply to all business relationships between MyMaid GmbH (hereinafter referred to as “MyMaid”, “MyMaid GmbH”, “us” or “we”) and the customers (hereinafter referred to as “customer”, “private customer”, “company”, “company” or “you”) for the services provided by us (hereinafter referred to as “service/s”).

Individual agreements with customers take precedence over these General Terms and Conditions. Conflicting terms and conditions of the customer will not be recognized. The following service provisions also apply to the sale of goods in our shop.


MyMaid GmbH reserves the right to change these terms and conditions at any time. Any changes will be effective upon posting of the updated Terms and Conditions on the Website. The date of the confirmed date for the provision of the service is decisive for the currently valid version of the General Terms and Conditions.


Please read these Terms and Conditions carefully before making an appointment with us. By confirming an appointment, you agree to the following conditions and our privacy policy.

​1. Performance and contract fulfillment

1.1 Subject of the contract

MyMaid offers professional cleaning services that are carried out under work contracts. Services include cleaning of homes, offices and commercial facilities. MyMaid reserves the authority to select and employ cleaning staff. MyMaid determines the specific distribution of tasks.

1.2 Fulfillment of agreed services

MyMaid ensures that all cleaning tasks are carried out according to agreed standards. Companies can develop a specification document in collaboration with MyMaid.

2. Appointment, conclusion of contract and termination

2.1 Start of contract

Appointments can be made [via our online reservation system]. The contract for the provision of services is concluded when we confirm the appointment [via email, telephone or online portal].

 

MyMaid GmbH reserves the right to cancel or postpone an appointment due to unforeseen circumstances (e.g. staff illness) without incurring any costs or compensation. The contract remains valid until terminated.

2.2 Cancellation conditions

If a customer cancels or changes a confirmed cleaning appointment, the following cancellation fees will apply:

There are no fees for cancellations or changes made at least 30 days before the agreed date.

A fee of CHF 25 will be charged for cancellations or changes between 30 and 7 days before the appointment.

For cancellations or changes made within 6 days of the agreed date, full payment is due.

The agreed cancellation period applies to entrepreneurs. Unless otherwise specified, the contract provides for a minimum term of 3 months from the first cleaning and a subsequent 3-month notice period.

Each party reserves the right to terminate the cleaning service at any time, unless otherwise stated in the specific plan terms. The requirements stated in Section 2.2 apply to these provisions.

Cancellations or changes must be made by email, telephone or via the MyMaid portal.

3. Cleaning orders and conditions

​3.1 Initial assessment and scope of work for companies

At the beginning of the contract, an initial assessment of the rooms to be cleaned is carried out based on a specification sheet drawn up by the customer and MyMaid.

3.2 Scope of services for private customers

The services booked by the customer and the respective execution standards apply.

3.3 Changes to the Services

The customer can request changes or extensions to the agreed cleaning services during the contract term. Changes that result in an increased scope of work or higher costs must be confirmed by MyMaid.

3.4 Special requests

If the customer requests certain cleaning tasks that are not included in the standard service offer, these must be agreed upon separately and paid for additionally.

3.5 Cleaning materials and equipment

The customer is responsible for providing all necessary cleaning materials and equipment. Specific cleaning tools and materials can be requested from MyMaid if required.

3.6 Protection of MyMaid employees

Customers are advised that cleaning staff are not required to lift or move items that may cause distress. In addition, photographing or otherwise recording cleaning staff without their express consent is strictly prohibited.

4. Pricing, Payment and Reminders

​4.1 Invoicing

Cleaning services are billed based on hours worked. One hour equals 60 minutes. Payments can be made directly via TWINT or credit card. For companies, MyMaid also offers monthly invoices that can be paid by credit card, TWINT or bank transfer.

4.2 Payment terms

Private customers authorize MyMaid to temporarily block the amount of the service on their credit card, regardless of the chosen payment method. For companies, payments are due within 5 working days of receipt of the invoice (by email or post).

4.3 Reminder procedures and late payments

In the event of late payment, MyMaid will send a payment reminder (by post, phone call, SMS or email). The day following the expiry of the agreed payment period will be considered the day of default.

If the reminder deadline is not met, MyMaid reserves the right to charge a fee of CHF 15 for the first reminder to cover additional administrative costs. If no payment is received after the second reminder, the file will be forwarded to a debt collection agency. All associated costs will be borne by the customer.

4.4 Payment methods

The following payment methods are generally available to customers for service payments:

TWINT, credit card

By selecting a payment method, the customer authorizes MyMaid to process the payment either via their credit card details or via a payment service provider. In the event of a chargeback, MyMaid reserves the right to request reimbursement of all associated and processing fees from the bank.

MyMaid GmbH reserves the right to change the available payment options at any time.

5. Liability and Insurance

5.1 Liability of MyMaid

MyMaid GmbH excludes any liability, regardless of the legal basis, as well as claims for damages against MyMaid GmbH and any vicarious agents and vicarious agents. In particular, MyMaid GmbH is not liable for indirect damages, consequential damages, lost profits or other personal, material or purely financial damages to the customer.

 

This exclusion of liability does not apply in cases of mandatory legal liability, such as gross negligence or intent.

Events beyond our control

In the event of an event beyond our control and influence (so-called force majeure), we assume no liability or responsibility for non-fulfillment or delay in the fulfillment of obligations arising from these terms and conditions or the associated contractual relationship. Examples of events beyond our control include, but are not limited to, strikes, fires, explosions, storms, floods, earthquakes, epidemics or pandemics.
If such an event occurs and affects our ability to perform the contract, we will notify you as soon as possible.

 

5.2 Damage & Reporting

The customer is obliged to report damages within 28 days of occurrence. MyMaid cannot be held liable for any damage reported after this period. MyMaid is liable for damage caused by the cleaning staff while carrying out the contractual tasks within the scope of the company liability insurance (coverage for personal injury and property damage up to CHF 5 million).

6. Customer Responsibilities

6.1 Customer’s obligation to cooperate

The customer undertakes to support MyMaid in fulfilling the contract. This includes ensuring that cleaning materials such as cloths and cleaning products are in perfect condition and freely accessible and that the premises are accessible for cleaning.

The customer is responsible for ensuring that the information required to access the cleaning facility is truthful and complete. In order for cleaning to be carried out as agreed, changes to access conditions must be reported immediately. If access cannot be granted due to insufficient or incorrect information, MyMaid reserves the right to charge the customer the full fee for the planned service.

 

6.2 Key delivery

If the customer leaves keys to the cleaning staff, this is entirely at the customer's own risk. MyMaid assumes no liability for loss, theft, damage or improper use of the keys or for any consequences resulting therefrom. If the keys are lost or there is a possible security risk, the customer must inform MyMaid immediately in order to reduce possible risks.

7. Personnel selection

8. Confidentiality and Non-Competition

8.1 Trade Secrets

MyMaid undertakes to treat all information obtained as part of the contractual relationship confidentially and not to pass it on to third parties. This confidentiality obligation remains in effect even after the contractual relationship has ended.

 

8.2 Non-Competition Agreement

During the term of the contract and up to one year after termination of the contractual relationship, the customer is prohibited from poaching employees from MyMaid or engaging in competitive activities against MyMaid.

9. Adjustments and Changes

9.1 Price and contract changes

Our offers and prices are as stated on the website and in store. All prices are in CHF (Swiss francs) and, unless otherwise stated, include VAT.

MyMaid GmbH reserves the right to change its offers and prices at any time. All offers are subject to change and are not to be understood as binding cost estimates.

MyMaid GmbH does not guarantee that the services listed are available at the time the service is provided. All performance information is therefore provided without guarantee and can be changed at any time and without prior notice.

10. Warranty for Goods

The customer is obliged to inspect the purchased item immediately after purchase and to report any defects for which MyMaid GmbH guarantees. Such defects must be reported immediately in writing by letter or email to the address of MyMaid GmbH. MyMaid GmbH will contact the customer after checking the report.

Returns to MyMaid GmbH are made at the customer’s expense and risk. The customer must send the goods in their original packaging, complete with all accessories and with a detailed description of the defects to the return address provided by MyMaid GmbH.

11. General Provisions

​11.1 Choice of law and place of jurisdiction

These General Terms and Conditions (GTC) are subject to Swiss law. The place of jurisdiction for all disputes is Zurich, Switzerland.

11.2 Validity of the General Terms and Conditions

These Terms and Conditions are effective January 1, 2025 and supersede all prior agreements and conditions.

12. Privacy

​The information and content published on the website is protected by copyright and is the property of MyMaid GmbH or the respective rights holder. Reproduction, processing, distribution or any other form of exploitation requires the prior written consent of the respective rights holder. MyMaid GmbH and the respective rights holder expressly reserve all associated rights.

14. Severability clause

If any provision of these Terms and Conditions is unlawful, invalid or unenforceable for any reason, this will not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision should be replaced by an effective provision that comes closest to the economic purpose and intentions of the parties at the time the contract was concluded. The same applies to any gaps in these terms and conditions.

15. Changes

These Terms and Conditions may be changed from time to time without notice. Unless otherwise stated, any changes to these Terms and Conditions will be effective upon posting on the Website.
